Migration Act of 1958 Section 275 Australian legal practitioner means a lawyer who has a practicing certificate given under the Territory or State law.

• This condition is not considered as a disciplinary measure and this is done by the authority for disciplining the legal practices.

278A Eligibility for restricted legal practitioners Eligibility: General

• This section is for the person who has a restricted legal practitioner and they get eligibility.
• The person has the eligibility under the following conditions:
• If the person becomes an unrestricted legal practitioner.
• Under this section, the eligible period is extended.

Under the eligibility, when there is a legal practitioner, the practitioner can become or they can become a registered migration agent. The eligibility is the 2 year which comes with a practicing certificate. Extension of eligible period The eligible person may apply within the extended time to the migration authority and this allows the extension of 2 years.

• If the application is made 3 months or more before the eligible period then the person can apply for the extension in this application.

Period of registration The registration agent period ends after 12 months on the day of registration. These changes are made so that the migration agent can provide better service to the applicants coming to Australia. Cancellation of registration—Australian legal practitioners The migration authority cancels or removes the migration agent name from the entire process if they are satisfied with the following reasons:

• The agent should be an unrestricted legal practitioner
• The legal practitioner is not allowed to provide the given service.

When the registration is canceled it is important to give a specific reason and the person needs to be informed with a written notice. 306C Definition of client The registered migration agent client is a person to whom the services are given or they are agreed upon they will provide them all the migration assistance to apply for the visa. In case, the migration agent becomes inactive while he is a registered migration agent even then they will be his or her client. The migration agent needs to give in writing to the registration authority within 28 days that they have become: (a) a restricted legal practitioner (b) an unrestricted legal practitioner.
