The four obligation areas

Character. Financial. Notification. Future limits.

Partner visa sponsorship creates obligations in four specific areas. Each has consequences for both the sponsor and the applicant if breached.

Character

Sponsor must pass a character assessment. Past convictions, especially involving family violence or sex offences, can disqualify. See character test.

Financial support

Sponsor undertakes to provide financial support for the applicant. Evidence of income and capacity reviewed at sponsorship application.

Notification

Sponsor must notify the Department of relevant changes: relationship end, criminal charges, change of address, and more. Failure to notify is itself a breach.

Future sponsorship limits

Sponsoring a partner triggers a 5-year sponsorship limitation on the sponsor. Subsequent partner sponsorships are often blocked or heavily scrutinised.

Character scrutiny

Sponsors are checked. Not just applicants.

Many sponsors are surprised to learn the Department investigates their history in detail.

Family violence convictionsA sponsor with family violence convictions can be refused sponsorship approval, especially if the applicant is from a vulnerable background.
Sex offences against childrenMandatory disqualification in most cases. Sponsor cannot sponsor any partner.
Recent offences and pending chargesPending matters pause the application. Recent offences trigger scrutiny proportionate to severity.
Overseas criminal historySponsors must disclose overseas convictions. The Department may require overseas police checks for the sponsor.
Future sponsorship limitation

Partner sponsorship carries forward consequences many sponsors do not anticipate.

5-year waiting period

After sponsoring a partner, the sponsor cannot sponsor another partner for 5 years. Exceptions exist for compelling circumstances.

Lifetime limit of 2

A person can sponsor a maximum of 2 partners in their lifetime. A third partner sponsorship is generally not permitted.

Prior failed sponsorships

If a previous sponsorship failed or ended badly (relationship breakdown soon after grant), future sponsorships face heightened scrutiny.

Sponsors with family violence convictions can be refused.

The Department will not generally approve sponsorship by a person with family violence convictions, particularly if the applicant is from an overseas background or has limited English. This is a protective measure that applies even if the current relationship is genuine.

Can a sponsor be refused approval even if the relationship is genuine?
Yes. Sponsor character is a separate test from relationship genuineness. A genuine relationship can still be refused if the sponsor fails the character requirement.
How long do sponsor obligations last?
Financial support obligations typically last for 2 years after permanent visa grant. Character and notification obligations apply during application processing.
Can I sponsor a new partner soon after a divorce from a previously sponsored partner?
The 5-year rule applies. Compelling circumstances exceptions are narrow. Specialist advice is required.
What if the sponsor has been in Australia less than 5 years?
Sponsor usually must be an Australian citizen or permanent resident. Length of residence can affect some specific sponsorship tests.
