Subclass 040/041 · 5-Day Emergency Bridge

Your visa just ended and you need five lawful days to lodge.

Or an immigration officer at a border needs to hold your lawful status while you prepare a proper application. The BVD is a short-term emergency bridge. It is granted by immigration officers in specific circumstances, not on request.

When a BVD applies

Two scenarios.

The BVD is rare. Two specific scenarios trigger it.

Subclass 040 (immigration cleared)

For people who are inside Australia and immigration cleared, but whose substantive visa has just ended. Short window to lodge a new application.

Subclass 041 (in immigration clearance)

For people still in the process of immigration clearance at a border who need lawful status while making a full application.

5-day duration

Duration is typically 5 working days. Not extendable. On day 6, if no application is lodged, the holder becomes unlawful.

No work, no travel

BVDs do not generally grant work rights. They do not grant travel. They exist purely to hold the status quo.

BVD to the next step

Lodge before day 6.

The BVD is not a destination. It is a holding pattern while you prepare and lodge a real application.

Lodging during a BVDLodging a valid substantive visa application during the BVD window usually triggers a BVA or BVC, depending on circumstances.
Not applied for onlineBVDs are granted by immigration officers in specific circumstances, not through an online lodgement channel.
No work rightsBVDs do not grant work rights. Any work during the 5 days is a breach.
Do not plan around a BVDIf your substantive visa has just ended, lodge a real application. Do not rely on a BVD being offered.
What to do inside the 5 days

48-hour lodgement preparation.

We draft and lodge applications inside 48 hours when the situation demands it. BVDs compress timelines but they do not remove them.

Day 1-2

Consultation and case strategy. Which substantive visa pathway fits your circumstances? Document gathering starts immediately.

Day 3-4

Full application drafted and evidence packaged. Quality and speed are both non-negotiable.

Day 5

Application lodged via ImmiAccount. New bridging visa (usually BVA or BVC) triggers. Lawful status continues.

BVDs are rarely granted on request.

They are usually offered by an immigration officer at a border or after a short interview. If your substantive visa has just ended, do not plan around a BVD. Lodge a real application.

Common questions

The questions we hear most.

For urgent BVD situations, book with Sourabh Aggarwal immediately.

Can I apply for a BVD online?
No. BVDs are granted by Immigration officers in specific circumstances, not through an online lodgement channel.
Does a BVD allow me to work?
No. BVDs are for lodging a substantive visa only.
What if I cannot lodge within 5 days?
You become unlawful. Speak to a migration lawyer immediately about BVE pathways or voluntary departure.
Can a BVD be extended?
No. The BVD ends at day 5. A valid substantive lodgement during that window triggers a different bridging visa.
