Unlawful at lodgement
Visa had already expired before the new application was lodged. BVC issued to bring you back to lawful status.
BVC advice is handled by Sourabh Aggarwal and Prateek Maan. Our Brisbane, Darwin, and Gold Coast offices handle urgent bridging matters. Applicants who lodged while unlawful, or who were on a BVE at lodgement, typically receive a BVC. The BVC comes with stricter conditions than BVA including limits on work rights. Here is what BVC means and the risks to manage. For full detail, see the BVC pillar page.
BVC is specifically for applicants who were not holding a substantive visa at lodgement.
Visa had already expired before the new application was lodged. BVC issued to bring you back to lawful status.
Already on a BVE when the new application was lodged. BVC may replace the BVE.
Some post-refusal pathways result in BVC rather than BVA for the new application.
BVC has specific restrictions that BVA does not.
BVC is functional but flags strategic concerns worth addressing.
Future visa applications may see the prior compliance gap. Transparent disclosure better than hoping it is not noticed.
Work rights need to be specifically applied for. Plan the evidence of hardship or need.
Avoid further compliance gaps while on BVC. Another gap compounds the issue.
Unlike BVA, which usually inherits work rights from the previous visa, BVC holders must apply separately for work rights. Many applicants are surprised by this. Plan accordingly and apply for work rights promptly if income is needed.
